About the user license/copyright and video/image rights
1.1) Can I freely use the images displayed on TYBA Online?
You may use the low-resolution, watermarked image samples we provide on our web site to help you conduct research and selectimages. If you intend to use our images for publication in any fashion,
contact us to arrange the terms of use first.
1.2) What must I do to use the photos from TYBA Online?
You must
contact us by email or phone to arrange payment for the license to use our copyright image(s), and for preparing and sending your chosen images in high resolution.
1.3) What is copyright?
It is the right of an author, for each individual creative or intellectual work, to enjoy the moral and economic benefits resulting from the production of his or her creation(s). By creating any artistic or intellectual work, the author gets two rights: moral and patrimonial. The moral right for an author to be identified as the creator of his or her work at all times when the work is displayed in public or published is indispensable.Economic rights are negotiable, with the author and/or his or her representative(s), for a specified period of time or in perpetuity.
Photographs are protected by copyright law, Law No. 5988 of 14 December 1973, revised by Law No. 9610 of February 19, 1998, and by Law No. 12.853, of August 14, 2013, subject to Item XXVII of Art. 5 of the Federal Constitution of 1988, which is in accord with the Berne Convention, established in 1886, in Switzerland, of which Brazil is a signatory. 1.4) When a photo and/or video features one or morepeople,do I need to ask permission from the person(s)? What are the image rightsin these cases?
Yes, anyone who publishes a still or video image of a person must have prior authorization, known as image rights, because the image of a person is protected by the Brazilian Constitution in Art. 5, Item X, which states: "are inviolable the intimacy, the private life, the honor and the image of the people, securing the right of indemnity by material or moral damage resulting from its violation."
TYBA and its represented professionals, in some cases, have signed authorization to use the image(s)of photographed and filmed people, or their parents (if they are minors), to pre-established goals. However, it is up to anindividual to be morally, socially and politically responsible for the use of his media image in context (whether used in public or private;in documents, works of art, and of public notoriety or not). 1.5) How do I identify on TYBA Online which photos and videos featuring individuals have pre-signed authorization for the use of his or her image?
Just check to see if "RELEASED #"is included in the picture caption.
1.6) If I "buy" an image, does it then belong to me? Can I use it as often as I like?
The amount paid for the use of an imageis restricted to what was previously agreed to, set out in writing and signed by the parties. This is called the LR (License to Reproduce Artwork or Images) agreement. To reuse an image, however, you can simply
contact us to update the conditions of your contract forthat image's use.
Note: Although the term "customer" is often used when negotiating the use of a picture, the correct term would be closer to "renter",because the right to use the image(s) are negotiated to be temporary and the property rights of the picture always remain with the author.
1.7) What exactly is an LR (License to Reproduce Artwork or Images)?
The LR is the legal basis for the publication(s) of the image(s). In an LR, all items are listed according to the type and length of publication, and must be signed by the legal representatives of all parties involved. Its absence makes the company or individual who has made use of the image(s) subject to fines and other penalties as provided by law.
How to use
2.1) Can I use images that are online?
Yes here's how:
1.Register, so you can set up an account and request quotes.
2. Use "Quick Search" or "Advanced Search" to search for images. For more information, see "how to search".
3. Use the Lightbox to save your pre-selected photos. Select the photos you prefer by clicking within the white square on the right side of your preferred photosin your Lightbox, and then click the "Quote" button.
4. Complete as many fields as you can in the quote request form and confirm by clicking the "ok" button at the bottom page.After doing this, you will receive an e-mail confirmation of your request.During weekdays, we will respond by e-mail with your completed quote within a maximum of 12 hours.
5. After a written agreement has been signed by all parties regarding the use of the photo(s) and corresponding value(s), we will send the photo(s) in high resolution by e-mail.

2.2) Can I "save" a picture from TYBAOnline on my computer? How do I do this?

Lightbox
3.1) What is a Lightbox?
It is aprivateplacewe provide to you on our site to help you organize your search.
You can create, share and send multiple Lightboxes, according to what your project requires.
The Lightbox is available to you in 2 different views:
A - a fixed horizontal bar at the bottom of your screen on search result pages, allowing you to browse through your search results while always having a view of your Lightbox, soyou can add or remove photos in your Lightbox without having to move back and forth between pages.
B - a full screen for better visibility of images addedto your Lightbox. This view can be accessed directly by clicking on "My Account" and then "Lightbox", or by clicking on "expand" on the horizontal bar view of your Lightbox.
To use this service you must

3.2) How do I add or remove images from my Lightbox?
You can simply drag your chosen image(s)to your Lightbox, or alternately you can click the Lightbox icon
located below each image.
To remove, select the image(s) you want to remove using the white box next to each photo and then click the "X" icon below.
To select all the photos, click on the red box all the way to the left below the Lightbox icon

Watermark
4.1) What is a watermark?
The watermark is a graphic on the scanned image that identifies its origin and at the same time protects the image from unauthorized use. On TYBAOnline, the TYBA symbol (
) is imposed transparently on every imagewith the phrase "Copyright © TYBA".
4.2) How can I get an image without the watermark for my layout?
You must register and provide information about the purpose of your layout. Images without a watermark are only released to registered customers. If you have any further doubts about the process,

5.1) Why should I register?
So you can receive images without a watermark for your layout, and also to make use of the Lightbox feature.
5.2) How do I register?
Just click on the
"register" link in the navigation bar of our site. Sign up is free.
5.3) I forgot my password. What do I do?
Click
"login" in the navigation bar of our site, enter the email with which you registered and click on "
forgot password". You will receive an email with your password.
